Introduction

In compliance with the Personal Data Protection Act 2010 (“the Act”) and its regulations, this notice is issued to all our valued external Stakeholders and/or prospective Stakeholders of Fosroc Asia Sdn Bhd & Fosroc Sdn Bhd (“the Company”). This Notice will inform you of your rights with regards to your personal data that has been and/ or will be collected and processed by us.

Collection of Personal Data

During the course of dealing with the Company it has and will collect and process your personal data , to meet its legal, statutory and contractual obligations and to provide you with it’s products and services. Your personal data enables the Company to achieve the “purpose herein that is in connection with our business”.

The Company will never collect any unnecessary personal data from you and does not process your data in any way, other than as specified in this Privacy Notice.

Purposes for Collection of Personal Data

The Company may use your personal data for the following purposes:

  • Administrate or otherwise carry out its obligations in relation to any agreement you or your business or employer have with it;
  • Anticipate and resolve problems with any goods or services supplied to you;

  • Send you information about products and services.
  • Certain data is collected automatically via our website, as described later in this Privacy Notice.
  • Staff from the Company, or from our licenses and distributors, may contact you from time to time by e-mail or by telephone in order to get your views and comments on the service it provides to you.

 

Sources of Personal Data

The Company may obtain Stakeholders’ personal data from the following sources, including but not limited to:

  • Application forms
  • Website enquiries
  • Business Cards
  • Emails
  • Telephone calls
  • Product Seminars, Webinars and Trade Shows

 

Disclosure of Personal Data

The Company may disclose Stakeholders’ personal data to other subsidiaries within its group of companies. These subsidiaries will treat Stakeholder personal data as confidential, in accordance with the Company’s Personal Data Protection Policy and with all applicable Data Protection Legislation, and will process such personal data only for the purposes and within the terms set out herein. The Company is responsible for the personal data under its control, including personal data disclosed by the Company to a Vendor (Data Processor). The Company takes every measure to provide a comparable level of protection for personal data should the data be processed by a Vendor. The Company is committed to complying with the Personal Data Protection Act 2010, in particular its policies as well as corresponding guidelines and orders.

Other than the disclosures referred to in this policy, the Company will not disclose any personal data without your permission unless it is legally entitled or obliged to do so (for example, if required to do so by Court Order or for the purposes of prevention of fraud or other crime).

The Company will only sell your personal data to a third party as part of a sale of the assets of a Fosroc Group company.

Security of Personal Data

The Company uses strict procedures, and security features to prevent unauthorised access to personal data wherever possible.

The Company strictly limits access to personal data to those employees or third parties who need this data to provide customer service to its Stakeholders, or must otherwise come into contact with this data to perform their jobs. The Company has also implemented technology and policies to help safeguard your data from unauthorised or improper use and will continue to update these measures as new technology becomes available.

When personal data is stored by the Company, it uses computer systems with limited access housed in facilities using physical security measures. Data stored in cloud services is in an encrypted format including when the Company utilises 3rd party storage. Personal data which is kept in non-electronic format/hardcopy is kept to a minimum and is also treated with strict procedures and physical security measures.

 

Website Data

Log files/IP addresses

When you visit the Company’s website, it automatically logs your IP address (the unique address which identifies your computer on the internet) which is automatically recognised by the Company’s web server. The Company uses IP addresses to help us administer the site and to collect broad demographic data for aggregate use. The Company does not link IP addresses to personally identifiable data. Use of Cookies

The Company may store some data, commonly known as “cookies” on your computer when you visit its websites. This data facilitates your use of our sites and helps us to provide you with the best level of service. For example, cookies ensure that you do not need to re-enter your details every time you visit our sites and help us to share advertisements which are relevant to your interests.

You can erase or block cookies from your computer if you want to (your help screen or manual should tell you how to do this), but certain Fosroc services may not work correctly if you set your browser not to accept cookies.

Third party sites

The Company cannot be responsible for the Privacy Policies and practices of other websites even if you access them using links from its sites and it is recommended that you check the policy of each site you visit.

In addition, if you linked to any of the Company’s sites from a third party website, it cannot be responsible for the privacy policies and practices of the owners or operators of that third party site and recommends that you check the policy of that third party site and contact its owner or operator if you have any concerns or questions.

Transferring Personal Data outside of Malaysia

In order to process data submitted by you via telephone, email or through any of our sites and to provide any data or assistance requested by you, the data you provide to the Company will be stored on Fosroc servers outside Malaysia, currently located in Singapore, and by submitting data you consent to this transfer of data. Your data may also be transferred to other countries outside of Malaysia. By way of example, this may happen if one of the Company’s service providers is located in a country outside of Malaysia. The Company also shares data between its group companies, which are located in countries worldwide, in order to provide any data or assistance requested by you. These countries may not have similar Data Protection laws to Malaysia. If the Company transfers your data outside of Malaysia in this way, it will take steps to ensure that your privacy rights continue to be protected.

Data about products and services

It is very important to the Company that it provides you with the highest level of service. In order to help achieve this, from time to time companies in the Fosroc Group may send you details of products and services which may be of interest to you. If at any time you do not wish to receive these details, please send an e-mail message to [email protected]

The Company only ever retains personal data for as long as is necessary and has strict review and retention policies in place to meet these obligations.

Where you have consented to the Company using your details for direct marketing, it will keep such data until you notify it otherwise or withdraw your consent.

Data Subjects Obligations

It is necessary for the Company to collect and retain Stakeholders’ (Data Subjects) personal data to provide data on its products and services. Therefore, it is also necessary for Stakeholders to supply personal data that is accurate and complete.

Stakeholders are not obliged to provide their personal data to the Company, however, where this data is required to either provide you with its services, deliver your products or meet its legitimate interests, it may not be able to offer some or all of its services without it.

 

The Rights of the Data Subject

You have the right to access any personal data that the Company processes about you and to request data about: 

  • What personal data is stored about you

  • The categories of personal data concerned
  • The recipients to whom the personal data has/will be disclosed to
  • How long the Company intends to store your personal data for
  • If the Company did not collect the data directly from you, data about the source

If you believe that the Company holds any incomplete or inaccurate data about you, you have the right to ask it to correct and/or complete the data and it will strive to do so as quickly as possible; unless there is a valid reason for not doing so, at which point you will be notified.

The Company aims to keep data about you as accurate as possible. If you would like to review or change the details you have supplied, you may do so at any time by contacting [email protected] If you have another query relating to your data, please contact the Company as per contact details below.

You also have the right to request withdrawal of consent and erasure of your personal data in accordance with the data protection laws; as well as to object to any direct marketing from the Company.

If the Company receives a request from you to exercise any of the above rights, it may ask you to verify your identity before acting on the request; this is to ensure that your data is protected and kept secure.

Changes to Privacy Policy

The Company reserves the right to update and amend this Privacy Notice and its Personal Data Privacy Policy from time to time. The Company will notify you of any amendments to this Privacy Notice or our Personal Data Privacy Policy via announcements on its Website or other appropriate means. Any amendments will only apply to personal data collected after the revised Privacy Notice or Personal Data Privacy Policy has been issued.

In accordance to Section 7(3) of the PDPA , this Privacy Notice is issued in both English and Bahasa Malaysia. In the event of any inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail
